FreeApply Recruiter Terms
These terms apply to any recruiter, staffing firm, employer or other organization ("Recruiter") that accesses FreeApply Talent Pool profiles. They are an agreement between the Recruiter and MyBotsAI ("we"). Job seekers are shown these terms so they know the rules recruiters must follow.
1. Permitted use
Recruiters may use Talent Pool profiles only to evaluate and contact candidates about specific, genuine employment opportunities. Recruiters must not sell, rent, license, publish or transfer profiles or contact details to anyone else, add them to marketing lists, use them for anything other than recruiting, or scrape or bulk-export them except through tools we provide.
2. Lawful and fair hiring
Recruiters must comply with all applicable employment, anti-discrimination, privacy, anti-spam and telemarketing laws, including Title VII, the ADA, the ADEA and state equivalents, CAN-SPAM, the TCPA and GDPR where applicable. Recruiters must not use profiles to discriminate on the basis of any protected characteristic. Recruiters must not ask candidates for payment of any kind.
3. Not a consumer report
Talent Pool profiles are written and supplied by the candidates themselves. We do not verify, rate, score, rank or add any evaluation to them, and they are not consumer reports. A Recruiter that wants a background check or consumer report must obtain one separately in compliance with the Fair Credit Reporting Act and state law.
4. Candidate data rights
Recruiters act as independent controllers or businesses for the profile data they view or save. They must keep it secure, keep it only as long as needed for recruiting, honor candidates' requests to stop contact and delete their data, and delete a profile within 30 days of our notice that the candidate has left the pool or asked for deletion.
5. Fees, suspension, liability
Access may require payment under a separate order. We may suspend or end access for any breach of these terms. Profiles are provided "as is" without warranty of accuracy. Recruiters will indemnify us against claims arising from their use of profiles or breach of these terms. These terms are governed by the laws of the State of Colorado, with exclusive venue in the state or federal courts located in Colorado.
