FreeApply Terms of Service
These Terms of Service ("Terms") are an agreement between you and MyBotsAI ("we", "us"), the publisher of FreeApply, a free job-search tool made up of a local MCP server, a local dashboard and agent instructions ("FreeApply" or the "Software"). By selecting "I agree" or by using FreeApply, you accept these Terms and our Privacy Policy. If you do not agree, do not use FreeApply.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use FreeApply. You may use it only for your own job search, not on behalf of anyone else and not to apply for jobs in another person's name.
2. What FreeApply does
FreeApply runs on your own computer. It stores your settings, resume and job-tracking records locally, shows them in a local dashboard, and gives an AI assistant you choose (such as Claude) tools and instructions to find job postings, prepare application materials and, if you direct it to, fill out and submit applications on your behalf, and to check your email for replies through connectors you authorize. FreeApply is free. We may change, suspend or stop offering any part of it at any time.
3. Your responsibilities
- Accuracy. You are responsible for every application, answer and document submitted using FreeApply. You agree to provide only truthful information, to review what the agent prepares, and to correct anything inaccurate. Do not use FreeApply to misrepresent your identity, qualifications, work authorization or experience.
- Your accounts and third-party terms. FreeApply acts inside your own browser sessions and accounts (for example, LinkedIn, job boards, employer career sites and email). You are responsible for complying with those services' terms. Some services, including LinkedIn, restrict automated activity and may warn, limit or close accounts that use automation. You use automation on those services at your own risk.
- Credentials. FreeApply is designed never to ask for, store or type your passwords or verification codes. Do not enter credentials into FreeApply. Keep your devices and accounts secure.
- Your AI assistant. Your use of the AI assistant and its connectors is governed by that provider's terms and privacy policy, not ours.
- Lawful use. You will not use FreeApply to break any law, to send spam, to scrape or overload websites, to bypass CAPTCHAs, access controls or rate limits, to discriminate against anyone, or to interfere with any service.
4. No guarantee of results
FreeApply does not guarantee interviews, offers, employment, response rates or any other outcome. Job postings, pay information and employer replies come from third parties and may be wrong, out of date or fraudulent. AI output can contain mistakes. Hiring decisions are made solely by employers.
5. Data sharing choices
FreeApply keeps your data on your computer. When a sharing choice is on, it sends us the limited data the Privacy Policy describes. Which choices are on by default depends on where you are, as the Privacy Policy explains. Each choice is separate and optional, and FreeApply works the same whether or not you share. You can change your choices or ask us to delete shared data at any time in the dashboard. For usage statistics and job-market data, you grant us a worldwide, royalty-free, perpetual license to use, analyze, publish and commercialize that data only in de-identified or aggregated form that does not identify you, for example job-market statistics.
5A. Recruiter Talent Pool
If you join the optional Recruiter Talent Pool, you authorize us to store your talent profile and to make it available to recruiters and employers who accept our Recruiter Terms, including for a fee that we keep. You grant us a non-exclusive, royalty-free license to host, format and display your profile for that purpose while you are in the pool. You confirm that your profile is accurate, that you have the right to share it, and that it contains no one else's personal information and nothing confidential to a current or former employer. Recruiters decide on their own whether to contact you. We do not guarantee contact, interviews or offers, and we are not an employment agency and do not act for any employer. You can leave the pool at any time in Settings → Data sharing, which removes your profile from new recruiter access.
6. License and ownership
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use FreeApply. If FreeApply's source code is distributed with an open-source license, that license governs your rights in the code, and these Terms govern your use of FreeApply and any service we host. The FreeApply name and branding belong to us. Your resume, settings and records belong to you.
7. Feedback
If you send us suggestions or feedback, we may use them without restriction or obligation to you.
8. Disclaimer of warranties
FREEAPPLY IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT IT WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO SOME MAY NOT APPLY TO YOU.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST WAGES, LOST EMPLOYMENT OPPORTUNITIES, LOSS OF DATA, OR ACCOUNT SUSPENSION OR CLOSURE BY ANY THIRD-PARTY SERVICE, ARISING OUT OF OR RELATING TO FREEAPPLY, EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO FREEAPPLY IS LIMITED TO FIFTY U.S. DOLLARS (US $50). THESE LIMITS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW AND DO NOT LIMIT LIABILITY THAT CANNOT BE LIMITED BY LAW.
10. Indemnity
You will defend, indemnify and hold us harmless from any claims, damages, losses and expenses (including reasonable attorneys' fees) arising from your use of FreeApply, the applications and information you submit, or your violation of these Terms, any law or any third party's terms or rights.
11. Termination
You may stop using FreeApply at any time and delete it and your local data folder. We may end your access to any service we host if you violate these Terms. Sections 3 through 13 survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Colorado, and you and we consent to their jurisdiction, except that either party may bring a claim in small-claims court where eligible. If you are a consumer in a country whose law gives you the right to sue in your home courts or to rely on mandatory local consumer protections, nothing in these Terms takes those rights away.
13. General
These Terms and the Privacy Policy are the entire agreement between you and us about FreeApply. If any provision is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a transfer of FreeApply. These Terms carry the version number of the FreeApply release they ship with. We may update these Terms; when we do, we will change the effective date, and the dashboard will ask you to accept them again before you continue using FreeApply.
